When you use the Eureka Economic Development Department’s (“EurekaIsReady”) website, visit the City of Eureka or participate in any associated or sponsored programs, promotions, sweepstakes, games, raffles, or contests, the Eureka Economic Development Department and their partners may collect personally identifiable information via “cookies,” submission forms, surveys, and other technologies and techniques as described below.
Collected Information can include name, postal address, telephone, email, zip code, as well as demographic and behavioral associations and traits. The information collected is used for statistical reporting, to determine the effectiveness of the website’s content, programs, and advertisements, to “personalize” your experience on the Eureka Economic Development Department’s websites, including https://EurekaIsReady.com, by providing targeted advertising and/or promotional campaigns, and to contact visitors and potential visitors and to send promotional materials.
This website used a variety of tools and techniques to serve each visitor with custom content curated for their enjoyment. It is also designed to collect visitor information so that information about the city can be shared again even after a visitor leaves this website.

EXAMPLES OF OUR OFFICIAL BRAND PRESENCE ON SOCIAL MEDIA PLATFORMS INCLUDE THE CITY OF EUREKA FACEBOOK PAGE, THE CITY OF EUREKA PINTEREST PAGE, THE CITY OF EUREKA INSTAGRAM ACCOUNT, AND THE CITY OF EUREKA TWITTER ACCOUNTS.
By posting or otherwise making available any Content, or otherwise responding to or communicating with us on or via our official brand presence on social media platforms/sites and branded hashtags (including, without limitation Facebook, Twitter, FourSquare, Instagram, Google+, Flickr, LinkedIn, YouTube, and Pinterest, collectively “Social Media Platforms”) you represent and warrant that you are eighteen (18) years of age or older and that you agree to the following terms and conditions:
You irrevocably grant us, and our affiliates, licensees and assigns, a royalty-free, perpetual, non-exclusive, unrestricted right and license throughout the universe to copy, reproduce, modify, edit, adapt, translate, create derivative works of, publish, post, distribute, publicly perform, sublicense, or otherwise provide to others, your Content in any and all media, formats, and channels (now in existence or hereinafter developed) for any purpose, including advertising and commercial purposes.
Important Note: we may also use any ideas, suggestions, developments, and/or other material embodied in your posted Content as we see fit without any compensation or attribution to you. We will, however, try to credit you as the author/source of the Content and you agree that we may identify you as the author/source of the Content by referring to your Social Media Platform handle or identifier as we see appropriate.
You represent and warrant that the Content does not violate or infringe any rights of any third party, including, but not limited to, copyright, trademark, rights of publicity, and privacy.
Important Note: If any third-party content is included in your posted Content you must obtain permission from the content owner and attribute/credit such content to the owner.
Some other rules of the road:
- Don’t post any Content that is disruptive, abusive, vulgar, profane, obscene, hateful, threatening, harassing, defamatory, or which discloses personally identifiable information or private or personal matters concerning any person;
- Don’t post any Content that you don’t have the right to post/transmit (and grant us the rights above) under applicable law or under contractual or fiduciary relationship;
- Don’t impersonate any person, or falsely state or otherwise misrepresent your affiliation with a person or entity;
- You represent that all testimonials, endorsements and/or advertisements contained in your posted Content are truthful, accurate, and represent your opinion and personal experience.
- You agree to hold the Eureka Economic Development Department’s(sometimes referred to herein as “us” or “our”) and our affiliates, agents, and licensees (collectively, “Indemnitees”) harmless, and defend and indemnify the Indemnitees from any claim, disputes, demands, proceedings, cause of action, judgments, damages, liabilities, losses, costs or expense of any kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed which may arise out of or are in any way connected with your posted Content and/or your use of our official brand presence on Social Media Platforms.
These terms shall be governed by and construed in accordance with the laws of the State of California without giving effect to principles of conflict of laws. In no event will we be liable hereunder for extraordinary, consequential, indirect, or punitive damages, including lost profits.
Registration areas on our site may require users to provide personally identifiable information, which is subject to usage as described in “Information Collection & Treatment,” above.
Cookies and Other Technologies
To help us serve our visitors to the best of our ability, we collect non-personally identifiable information, including traffic data and information that identifies visitor computer or browser IDs. Cookies are pieces of information placed in the settings of your web browser by a website server to identify your computer when you return to a website. Whenever a site welcomes you and tailors data to your specifications, it is reading a cookie left in your browser and identifying information that you may have registered during previous visits, such as your viewing preferences.
EurekaIsReady’s website currently does not respond to “do not track” signals or other mechanisms that provide consumers a choice regarding the collection of personally identifiable information about an individual consumer’s online activities over time and across third-party online services.
If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. If it is included, visitors to the website may be able to download and extract location data from images on the website.
Embedded content from other websites
Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.
If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.
For users that register on our website (if any), we also store the personal information they provide in their user profiles. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.
We use reasonable security measures to protect against the loss, misuse, or alteration of personally identifiable and non-personally identifiable information collected via our website and under our control so that you can feel comfortable and secure when using the site. Notwithstanding the precautions that we take, we cannot guarantee the security of information that you transmit to us, and shall not be liable for any failure to safeguard your information, whether inadvertent or otherwise.
Disclosure for Legal Purposes
We may be required to share your personally identifiable information and non-personally identifiable information pursuant to judicial or governmental subpoenas, warrants, or orders. If we are legally required to do so, or, in good faith believe that we are legally required to do so, we will obey the law. In addition, we reserve the right to use, disclose and share your personal and non-personal information in order to promote the offerings of our city, and to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person or as otherwise required by law.
Disclaimer Concerning Third Parties
We may provide certain personally identifiable information to our partners. Furthermore, we may retain other companies and individuals to perform functions on our behalf. Examples include financial institutions, consumer e-mail service providers, web data tracking specialists, and reservation booking engines.
You may choose to remove yourself from our mailing list by completing our online Feedback Form, clicking the embedded opt-out link, and/or replying to any email sent to you, or by sending a request to EconDev@ci.eureka.ca.gov with “Eureka Opt-Out’ in the subject line.
Special Note Concerning Persons Under The Age of 18
Our online services are not directed toward persons under the age of 18, and we request that persons under the age of 18 not provide personally identifiable information to us nor participate in any contests or promotions designed to capture visitor information.
